Terms & Conditions of BaLi Moore Street Photography

 

Before you complete any purchase on this website, please read carefully the following Terms & Conditions below and accept all of it.

 

Definitions

  1. The Site : The website www.balimoore.com (on all its pages) 

  2. The Company : BaLi Moore (exempt dealer 39601372)

  3. The Products : All items offered for sale or displayed on the Site's shop

  4. The Customer : Any buyer / user / visitor of the Site

  5. The Terms : The following Terms & Conditions 

  6. Business Days : Sunday-Thursday, excluding Jewish holidays

  7. Shipping : Any delivery form of the Products to the Customer

General

  1. The Site is, inter alia, a website for purchasing original art photography products.

  2. Use of the Site and/or any purchase through the Site constitutes approval and full confirmation to these Terms & Conditions.

  3. The Customer or any representative of the Customer shall have no complaints or demands of any kind against the Site and/or the Company and/or its representatives on matters relating these Terms & Conditions.

  4. Hence, if you do not fully agree to all of the Terms & Conditions mentioned, you should refrain from purchasing or using the Site.

  5. The prices of the Products may update at times with no prior notice.

  6. The prices don't include VAT, as required by law (exempt dealer).

  7. The Company reserves the right to change and/or add and/or remove Products or Services listed on the Site with no prior notice.

  8. The Company may offer sales and discounts from time to time. The Company holds the rights to change or cancel these offers at any given time with no prior notice.

  9. The Company is not committed to keep in stock all of the Products listed and/or displayed on the Site.

  10. If an order had been made by a Customer and the ordered Product/s are not in stock or not available for Shipping, the Company will contact the Customer via email or telephone provided while placing the order, and the Customer will be entitled to either receive a refund or choose another Product/s at the same price.

  11. Limited edition artworks are numbered, signed and delivered with a certificate of authenticity. Each edition has a set of limited pieces available from the same dimensions and medium / type or Product offered. Once all artworks in each edition are sold out, there will be no other pieces available in the same dimensions and medium / type of Product. The Company reserves the right, at any time and without notice, to add and/or remove and/or make changes in the type of production and/or the Products.

  12. The Company reserves the right to refuse service and/or cancel an order placed on the Site by any Customer, at it's sole discretion.

  13. The images displayed on the Site are for illustration purposes only. The Company attempts to describe and display demonstrations and illustrations of the Products as accurately as possible. However, the Company does not warrant that such descriptions or that other content of the site are 100% accurate or free of any errors. In case of such innocent mistakes or inaccuracies, the Company will not be held responsible.

  14. There may be a color deviation between your device's screen and the actual printing. We are making our best efforts to supply high quality products, yet will not replace a Product due to color or texture issues.

  15. The maintenance, cleaning and any other use of the Products are the sole responsibility of the Customer. Once the order is delivered intact to the Customer, the responsibility of the Company towards the Customer is completed.

  16. It is forbidden selling Product/s bought or received from this Site to any third party. The Customer undertakes not to make any commercial use with Product/s purchased or received from the site.

  17. The Company is the one and only owner of all rights, including copyrights, of the Products and art photos displayed on the Site and/or offered for sale and of the whole Site.

  18. It is strictly forbidden to copy, distribute, sell or make any other commercial use of the Products and photos displayed on the Site.

  19. It is strictly forbidden to copy or to make any use, including commercial or marketing, of any content or information from the Site.

  20. These Terms & Conditions may change at times with no prior notice. 

  21. In case of any violation of these Terms and Conditions and/or an illegal activity and/or any damage caused by a Customer to the Company or the Site, the Company has the right to cancel an order made by the Customer, including after the purchase has been completed.  

  22. Any dispute concerning these Terms & Conditions and/or any purchase of Product/s and/or any other issue regarding the Site will be terminated by the exclusive jurisdiction of the courts of Israel under the laws Israel govern.

Returns and Cancellation Policy

 

Our Products are sent to you in an excellent quality and intact, after careful examination.

  1. In case of receiving a defective Product, the Customer is obliged to notify the Company about it within 24 hours of receiving the Product. If 24 hours have passed since receiving the Product with no such notification, this will constitute confirmation that the Product was received in a good condition and intact, and the Customer will have no demands or complaints against the Company concerning defects of the Product.

  2. If you wish to return a Product you must notify the Company through this email bali.22.moore@gmail.com within 7 days of receiving it.  

  3. Returns, replacements and refunds are possible only with an original receipt and package.

  4. Product purchased in a sale or received as a gift will not be refunded or replaced.

  5. Products which are produced especially for an order placed and which are not in stock are non returnable nor refundable.

  6. Returns can be done within 14 days of receiving the order, and just as long as the Product have not been used and is in new condition. Return fees and costs will be at the Customer's expense, and must be made through registered mail. Address for returns : Bali Moore, 4th Shalma Road, Tel-Aviv, 6811114, Israel.

  7. Refunds will be granted only if the returned Product is returned unused, undamaged and in new condition - as it was received. Refunds will not be possible for Product that have been used or damaged in any way (this includes damages done during shipping / delivery). After the Company will check and examine the returned Product to make sure it is well and intact to the Company's satisfaction, you will receive your money back minus the original shipping / delivery costs and minus cancellation fee in the amount of 5% or 100 ILS, whichever is lower, in accordance with the law. Refund will be credited to the Customer automatically via the means of payment used to place the order - credit card / PayPal account according to their policies.

  8. If a mistake is revealed in a Product price or description, the Company has a right to cancel a transaction / an order also after the purchase has been completed by the Customer.    

  9. The Company has a right to cancel a transaction / an order made by a Customer also after the purchase has been completed due to causes which are beyond its control such as : emergency, natural disasters, war, terrorist act, security incidents, technological faults etc.

  10. The Company reserves the right to cancel an order placed by a Customer in case illegal actions were taken and / or any violation of these terms & condition by the Customer. 

  11. In case of a cancellation of an order by the Company, the Company will notify the Customer of the cancellation through telephone and/or email provided by the Customer while placing the order.

Shipping / Delivery

 

We make our best efforts to make your delivery experience a good one (:

  1. The delivery time of your purchase changes according to the Products you have ordered, as we mostly produce them especially for you after you place the order. It can take up to 10 business days for your order to be ready, but we do our best to ship it as quickly as we can.

  2. The shipping fees change according to the destination, the Products and the delivery method. Shipping fees will be calculated in checkout.

  3. Domestic delivery fees within Israel only include deliveries in between Hadera and Gedera. For further and more distant areas within Israel, please contact us to find out delivery fees and options.

  4. The Shipping costs may update at times with no prior notice.

  5. International items may be subject to customs processing and additional charges, in accordance with the laws of the destination country. Such costs are the sole responsibility of the Customer.

  6. The Shipping will be sent to the address specified by the Customer when placing the order.

  7. If a sent Product is returned to the Company due to wrong or inaccurate information entered by the Customer when placing the order, resending it will be at the Customer's expese.

  8. The Company will deliver purchased Products to the Customer via an independent carrier / shipping company.

  9. The Company / Site will not be held responsible for the independent actions / inactions or delays of the carrier / shipping company of the Products. In this context, the Company will not be held responsible for any damages may caused to the Customer due to such actions / inactions or delays.

  10. Carrier / shipping companies sometimes refuse to deliver/ship to certain areas. When this happens, the Company will do its best to try and coordinate an acceptable area to both sides. In case no area is agreed on both sides, the Company is eligible to cancel the Customer's order. The Customer will not be entitled to any compensation of any kind for such cancellation. 

  11. The Company is not responsible for a delay in delivery due to causes which are beyond its control such as : holidays, bad weather, natural disasters, strikes, war, technological faults etc.

  13. The Company doesn't guarantee shipping / delivery to areas with limited access, or to countries other than the ones mentioned above.

  14. The shipping / delivery areas may change with no prior notice.

 

Privacy Policy

  1. By using the Site and/or placing an order, the Customer agrees to all of the Terms & Conditions, and willingly provides their personal information.

  2. By placing an order and/or by entering contact information, the Customer agrees to receive updates / promotional material / offers / advertisement via emails, text / WhatsApp messages or fax from the Company as defined in section 30a of the communications law. At any point the Customer will be able to remove oneself from the mailing list by following the removal Instructions which will appear at the bottom of these sent updates.

  3. The Company will not make unauthorized use of the Customer's personal information entered while placing an order. 

  4. The Company does not save the Customer’s credit card information. The transaction is executed securely via the credit card company.

  5. Payments methods we accept: secure credit cards payment or PayPal.
